En el presente artículo buscamos sistematizar algunas contribuciones del filósofo Walter Benjamin con la intención de pensar las infancias y la educación de la clase trabajadora en el contexto en que se formulan proyectos de ley, como Escuela Sin Partido, en Brasil. Son proyectos elaborados en los últimos años, que guardan un fuerte cuño conservador y de control ideológico. Buscamos en Benjamin la noción de experiencia y cómo ésta entra en relación con la infancia y el área de la educación, (...) así como sus contribuciones en lo que se refiere a la educación popular o proletaria. A partir de dichas nociones de la filosofía benjaminiana, analizamos propuestas educativas y proyectos de ley, como el mencionado, indagando sobre las concepciones de infancia, historia, experiencia y política que atraviesan ese debate. La intención aquí es pensar bajo una óptica benjaminiana el crecimiento de las ideas que orientan el proyecto Escuela sin Partido y su influencia en la educación de los niños pequeños, en especial, de los niños de la clase trabajadora. Con ese fin, apelamos a escritos del autor como: Experiencia, Experiencia y Pobreza, La vida de los estudiantes, Teatro Infantil Proletario, Pedagogía Comunista, El narrador y sus narrativas radiofónicas presentadas en radios de Berlín y Frankfurt, en las que se destaca la cultura y la vida cotidiana de los niños berlineses. Para empezar a recorrer los caminos de este estudio, que se inscribe en una investigación de doctorado en curso, también se recurre a las publicaciones como Gaudencio Frigotto y Jorge Larrosa Bondía, considerando el proyecto de ley federal nº 193/2016 (Escuela Sin Partido) como documento legal analizado. The first collection presented by Rei Kawakubo in Paris was classified as offensive to Western aesthetic standards, for it questioned the French ideal of beauty and elegance. Although in Italy there is currently no effective law on physician-assisted suicide or euthanasia, Decision No. 242 issued by the Italian Constitutional Court on September 25, 2019 established that an individual who, under specific circumstances, has facilitated the implementation of an independent and freely-formed resolve to commit suicide by another individual is exempt from criminal liability. Following this ruling, some citizens have submitted requests for assisted suicide to the public health system, generating a situation of great uncertainty in the application (...) processes. As a matter of fact, shared and defined procedures are lacking as Decision 242/2019 merely added some principles on which the legislature will have to base its future intervention. This paper analyses the advisory role that the Decision attributes to territorial ethics committees with the aim of stimulating discussions on their role in oversight mechanisms. The proposed conclusion is that the envisaged role does not appear consistent with the functions of these bodies and is ultimately substantially undefined and unjustified. (shrink)

PurposeTo explore and describe a trained communication partner’s use of responsive strategies in dyadic interaction with adults with Rett syndrome.IntroductionResponsive partner strategies facilitate social, communicative, and linguistic development. The common feature is that the communication partner responds contingently to the other’s focus of attention and interprets their acts as communicative. Research on responsive partner strategies that involves individuals with significant communication and motor disabilities remains sparse. The same applies to if, and how, the use of communication aids impacts on the (...) partner’s use of responsive strategies.Materials and methodsA therapist, trained in responsive partner strategies and aided communication interacted during 14 sessions with each of three participants. The participants were adults with Rett syndrome. A gaze-controlled device and responsive strategies were used during all sessions. The Responsive Augmentative and Alternative Communication Style scale was used to assess the partner’s responsiveness. RAACS consists of 11 items including ratings of to what extent the partner is being attentive to, confirms, and expands the individual’s communication. During eight of the 14 sessions, aided AAC Modelling was also used, i.e., the communication partner pointed at symbols on the gaze-controlled device while interacting. In addition to RAACS, each time the communication partner confirmed or expanded on communication when the participants used the gaze-controlled device and the participants did not use the gaze-controlled device was counted. Descriptive statistics were used to present the results. Non-parametric tests were used to compare means between the two conditions and between participants.ResultsInter-rater agreement for the different RAACS items ranged from 0.73 to 0.96 and was thus found to be fair to excellent. The communication partner’s use of responsive strategies varied when communicating with different participants and the scores were higher when aided AAC modeling was used. The communication partner’s number of responses and use of responsive strategies were higher when the participants communicated through a gaze-controlled device.ConclusionThe communication partner’s use of responsive and scaffolding strategies is not a fixed construct but varies in interactions with different non-speaking persons. The same is true whether the non-speaking person uses a gaze-controlled device with digitized speech or not. (shrink)

O plano ampliado e reconfigurado dos fluxos de informação na contemporaneidade sugerem novas condições para que a ação da leitura e da interpretação possa ser estabelecida. Com o objetivo de refletir sobre as implicações que fazem parte destas ações desenvolvemos um exame dialético parcial sobre três obras - Ser e Tempo, de M. Heidegger, Investigações Lógicas, Sexta Investigação: Elementos de uma Elucidação Fenomenológica do Conhecimento, de E. Husserl, e Investigações Filosóficas, de L. Wittgenstein - que, embora não tenham tido o (...) objetivo direto de analisar a leitura e a interpretação, parecem oferecer elementos para refletirmos sobre estes fenômenos na contemporaneidade. Ao final, nos posicionamos a favor da interpretação enquanto uma ação social a priori e discorremos, sinteticamente, sobre a configuração dos atuais sistemas de informação, considerando tal condição. This paper investigates the role of a pre-existing body-model that is an enabling constraint for the incorporation of objects into the body. This body-model is also a basis for the distinction between body extensions (e.g., in the case of tool-use) and incorporation (e.g., in the case of successful prosthesis use). It is argued that, in the case of incorporation, changes in the sense of body-ownership involve a reorganization of the body-model, whereas extension of the body with tools does not involve (...) changes in the sense of body-ownership. Purpose The purpose of this paper is to report on empirical work conducted to open up algorithmic interpretability and transparency. In recent years, significant concerns have arisen regarding the increasing pervasiveness of algorithms and the impact of automated decision-making in our lives. Particularly problematic is the lack of transparency surrounding the development of these algorithmic systems and their use. It is often suggested that to make algorithms more fair, they should be made more transparent, but exactly how this can be (...) achieved remains unclear. Design/methodology/approach An empirical study was conducted to begin unpacking issues around algorithmic interpretability and transparency. The study involved discussion-based experiments centred around a limited resource allocation scenario which required participants to select their most and least preferred algorithms in a particular context. In addition to collecting quantitative data about preferences, qualitative data captured participants’ expressed reasoning behind their selections. Findings Even when provided with the same information about the scenario, participants made different algorithm preference selections and rationalised their selections differently. The study results revealed diversity in participant responses but consistency in the emphasis they placed on normative concerns and the importance of context when accounting for their selections. The issues raised by participants as important to their selections resonate closely with values that have come to the fore in current debates over algorithm prevalence. Originality/value This work developed a novel empirical approach that demonstrates the value in pursuing algorithmic interpretability and transparency while also highlighting the complexities surrounding their accomplishment. En este artículo se analiza la doctrina kantiana de la definición. Se estudia el desarrollo de esa doctrina en las lecciones de lógica del período precrítico, a partir de su comparación con la teoría de las definiciones de Meier. Se sostiene que Kant organiza su estudio a partir de los aspectos escogidos por Meier, pero es crítico de sus tesis.

According to attention-based theories, to explain organizational attention is to explain organizational behavior. In our study, we test the model of situated attention and firm behavior by examining the effects of attention structures and allocation of attention on organizational outcomes. We hypothesize a positive relationship between attention structures and the allocation of organizational attention that, in turn, has an effect on financial performance. Using a unique data set composed of indicators of social responsibility published by 338 Brazilian organizations between 2001 (...) and 2007, we find support for our hypotheses. Our findings suggest that organizational attention to social issues fully mediates the relationship between attention structures and financial performance. (shrink)

O viver e o conviver implicam o fato de seres humanos estarem em congruência com o meio; neste sentido, é fundamental compreender as possibilidades e limitações do MDV3D para a construção da cultura emergente. Nuestro trabajo ofrece algunas claves de lectura del proceso por el cual fue posible que la actividad de los tribunales de justicia, a comienzos de los años '90 en Latinoamérica en general y en Argentina de manera significativa, adquiriese una relevancia y una consideración singular respecto al ejercicio del poder político. Este fenómeno, habitualmente denominado "judicialización de la política", supone una tendencia a procesar y dar respuesta a conflictos de índole política, a través de instituciones judiciales. En relación a ello, (...) nos interesa mostrar las interconexiones, puntos de apoyo, resortes a través de los cuales es posible ligarlo al diagrama de relaciones de poder y procesos de subjetivación que caracterizan a la gubernamentalidad neoliberal. Our paper offers some lecture keys on the process through which made it possible the political relevance of judicial activity during the 1990's in Latin American in general, and in Argentina in particular. This phenomenon, commonly known as 'judicialization of politics', supposes a tendency of processing political conflicts through the judiciary. Related to that our paper proposes to show, to make it visible, interconnections and supports through which it is possible to understand it emergence within the diagram of power relations and processes of subjectivation that characterizes neoliberal governmentality. En este artículo se examina la noción kantiana de las demostraciones matemáticas. Esta noción se encuentra desarrollada en el apartado titulado “Disciplina de la razón pura en su uso dogmático” de la _Crítica de la razón pura. _En este texto, Kant explica por qué los procedimientos exitosos en el conocimiento matemático resultan impracticables en metafísica. En primer lugar se estudian dos pasajes en los que el filósofo describe dos demostraciones: la demostración de la congruencia de los ángulos de la base (...) de un triángulo isósceles, y la demostración de que la suma de los ángulos internos de cualquier triángulo es igual a dos rectos. A continuación, se examina la descripción de la demostración matemática como una prueba apodíctica en la intuición. Este análisis muestra que la demostración matemática no constituye la misma clase de procedimiento presentado como demostración en los §§57 y 59 de la _Crítica del Juicio._. (shrink)

Decision-making capacity is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs from (...) existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)

En este artículo discuto la contribución de Matías Oroño, intitulada “El conceptualismo de Kant y los juicios de gusto”. Esta contribución, en lo esencial, es una crítica a la tesis según la cual es posible encontrar una fundamentación del no-conceptualismo kantiano en el tratamiento de los juicios de gusto. Esta tesis es defendida por Dietmar Heidemann en un artículo que Oroño refuta. En el presente artículo se sostiene que la interpretación de Oroño es acertada, con algunos reparos. Sin embargo, me (...) parece importante señalar que Oroño no cuestiona dos premisas del no-conceptualismo sostenidas por Heidemann que necesitan ser revisadas. Estas premisas son: los elementos no-conceptuales que interesan tienen valor cognitivo, esos elementos son fenoménicos, intencionales, representacionales. (shrink)

The concept of an artefact is central to several bioethical arguments. In this paper, I analyse this concept with respect to living and also non- living entities. It is shown that a close relationship between bringing an entity into existence and its intentional modification is necessary for its artefactuality. The criterion is further improved by analyses of the nature of intentionality in artefact production and the differences between artefacts and their side-effects. Further, in order to clarify the meaning of the (...) term 'bring into existence', issues related to sortal terms and functions of artefacts are considered. As the result of these analyses, the criterion for being an artefact is founded on the following double condition: An entity x is an artefact only if x has been intentionally brought into existence by intentionally causing the coming artefact x to have certain properties. An entity x is an artefact only if causing x to have certain properties has led x to have some new functions – that is, functions that are not present in the raw materials of x. The double condition is used for clarifying the status of several biotic entities such as gardens, commercial fields, polluted natural areas, ecosystems including alien species, restored ecosystems and transgenic organisms. The European Commission has recently proposed the introduction of legally binding quotas for women on corporate boards of European companies. This proposal has put the spotlight on the question of whether increasing female representation on the board brings economic benefits to the firm. In order to shed light on the issue, this study investigates the direct and indirect effects of women on the board on firm value. We use a simultaneous equation model to estimate the effects of women on the (...) board on firm value, financial performance, and compliance with ethical and social principles adopted by the firm. We find no evidence that a higher female representation on the board directly affects firm’s value. However, we find indirect effects. Women on the board are positively related with financial performance (measured in terms of return on assets and return on sales) and with ethical and social compliance, which in turn are positively related with firm value. The findings in this study suggest that greater female representation on corporate boards of large European firms can increase firm value indirectly. Further, part of the indirect effect comes from stronger compliance with ethical principles, something that is not captured by accounting-based financial performance. (shrink)

ver since the traditional criteria for medical decision-making capacity (understanding, appreciation, reasoning, evidencing a choice) were formulated, they have been criticized for not taking sufficient account of emotions or values that seem, according to the critics and in line with clinical experiences, essential to decision-making capacity. The aim of this paper is to provide a nuanced and structured overview of the arguments provided in the literature emphasizing the importance of these factors and arguing for their inclusion in competence evaluations. Moreover, (...) a broader reflection on the findings of the literature is provided. Specific difficulties of formulating and measuring emotional and valuational factors are discussed inviting reflection on the possibility of handling relevant factors in a more flexible, case-specific, and context-specific way rather than adhering to a rigid set of operationalized criteria. Guidelines orient best practices in medicine, yet, in health care, many real world constraints limit their optimal realization. Since guideline implementation problems are not systematically anticipated, they will be discovered only post facto, in a learning curve period, while the already implemented guideline is tweaked, debugged and adapted. This learning process comes with costs to human health and quality of life. Despite such predictable hazard, the study and modeling of medical guideline implementation is still seldom pursued. In this article we (...) argue that to systematically identify, predict and prevent medical guideline implementation errors is both an epistemic responsibility and an ethical imperative in health care, in order to properly provide beneficence, minimize or avoid harm, show respect for persons, and administer justice. Furthermore, we suggest that implementation knowledge is best achieved technically by providing simulation modeling studies to anticipate the realization of medical guidelines, in multiple contexts, with system and scenario analysis, in its alignment with the emerging field of implementation science and in recognition of learning health systems. It follows from both claims that it is an ethical imperative and an epistemic responsibility to simulate medical guidelines in context to minimize harm in health care, before guideline implementation. Com base na pesquisa sobre a presença de Paulo Freire na produção da Pós-graduação Brasileira este artigo tem o objetivo de destacar as categorias antropológico-filosóficas que embasam a concepção de Educação do autor e que são reveladas nessas produções. Essas concepções estão presentes em forma direta em 233 dissertações e 138 teses localizadas em 32 universidades onde foram defendidas as teses que pesquisaram sobre esse autor. Os resultados revelam que as categorias filosóficas de “ser no mundo”, “ser com outros”, “ser (...) inconcluso” e antropológicas de “realidade concreta”, “diálogo” e “liberdade/libertação” tem relações diretas com a problemática dos direitos humanos. Essas categorias fundamentam a base conceitual para a compreensão da educação como direito humano. (shrink)

Resumen: En el presente artículo buscaremos analizar los diversos tratamientos que Walter Benjamin ha realizado a lo largo de su obra acerca de la crítica como temática eminentemente filosófica. Para ello abordaremos, en primer lugar, su acercamiento a la poesía del Romanticismo alemán, luego a la poesía barroca y, finalmente, a la obra de Baudelaire con el objetivo de justificar que una comprensión acabada de la crítica implica necesariamente para el filósofo alemán recuperar la actualización como clave de lectura de (...) la historia. En efecto, si actualizar presupone para Benjamin la asunción de la no coincidencia del tiempo consigo mismo, esto es, la supervivencia del pasado en el presente y el potencial significante de sus emergencias, buscaremos mostrar cómo la noción de crítica benjaminiana descansa en ese diferencial temporal y encuentra allí su fuente de sentido.: In this article we intend to analyze the different considerations that Walter Benjamin carried out in his work on the problem of critique as an eminently philosophical subject. To do this, we will address, first, his approach to German romantic poetry, then baroque poetry and, finally, Baudelaire’s work, in order to explain how a full comprehension of critique means, for the German philosopher, to recover the idea of “actualization” as a key for reading History. In fact, if the actualization presupposes, for Benjamin, the assumption of the non-coincidence of time with itself, that is, the survival of the past within the present and its potentiality to signify, we try to show how Benjamin’s notion of criticism rests on that temporal difference and finds there its source of meaning.
